Your Acceptance

By using and/or visiting this website, you signify your agreement to these terms of service, our privacy policy and disclaimer.  You further signify that you have the legal standing to enter into such an agreement or have the permission of a parent or guardian who is entering into said agreement on your behalf.

Your Rights

You are granted permission to access the BREAKFALL.NET website (hereafter "BREAKFALL.NET," "BFN," "Website" or "the Website" ) provided that you follow the restrictions set forth in the following sections.

Restrictions on Use of the Website

1. You agree not to alter or modify the Website in any way beyond submitting your content in accepted manners;

2. You agree not to obscure or block any advertisements that may be displayed on BREAKFALL.NET;

3. You agree not to use BREAKFALL.NET for any commercial purposes without BREAKFALL.NET's prior, written approval.

4. You agree not to use any tool to access BREAKFALL.NET with a greater frequency than a normal human could access it with a standard web browser.  Search engine spiders may be exempted from this policy.

5. You agree not to harvest or collect any personally identifying information, including but not limited to E-Mail addresses or Instant Messanger account names.

6. You agree not to use the messenging facilities provided by BREAKFALL.NET for any commercial purposes.  You also agree not to send  an unreasonable number of messages in a short period of time.  Such definitions are created by the BREAKFALL.NET webmaster in his sole discretion.

Restrictions Regarding Use of Content

1. The uploader is considered to be the owner of all materials  he or she uploads.  Accordingly, you may not upload any material that you do not have the right to upload due to copyright, trademark, trade secret, patent or other legal restrictions.

2. You agree to grant BREAKFALL.NET a non-exclusive, semi-perpetual license to use your content on the BREAKFALL.NET website for whatever purpose the staff deems appropriate, including commercial uses.  You may revoke this license by removing your video from our database.  However, in the event that your account has been deleted, banned or restricted prior to removal of your content, BREAKFALL.NET's license is considered valid and BREAKFALL.NET is under no obligation to retroactively remove any of your content.

3. You agree to upload only videos related to backyard wrestling.  These include, but are not limited to, music videos, full matches, promotions ("promos"), announcements, flip videos, trailers and teasers.  Any videos that are not about backyard wrestling will be removed at the sole discretion of the staff of BREAKFALL.NET.

4. You agree that all content, including videos, comments and other functionality and content contained within the Website, is provided "AS IS" without warranty of any kind, including fitness for a particular purpose.

5. You agree that while BREAKFALL.NET makes every effort to ensure that the service remains functional and available, that you idemnify and hold harmless the creators, staff and users of BREAKFALL.NET from any losses incurred through the unavailability or misfunction of this service.

6. You agree not to post any videos or comments that contains any malicious software program, or to post links to any such content.

7. You agree not to disable or circumvent any security-related features of this website.

8. You agree that since BREAKFALL.NET operates based on user submissions, that BREAKFALL.NET is not responsible for the content, accuracy, usefulness, safety or intellectual property rights of the submissions.  You further agree to provide accurate information for all required fields, and agree that failure to do so may result in your content or account being removed or barred from further use of the BREAKFALL.NET servers.

Your Submissions and Interactions with Other Members

1. You agree not to harrass any member of BREAKFALL.NET through any medium, including but not limited to user and video comments, forum posts and private messages.  Harassment will be determined in the sole discretion of the BREAKFALL.NET staff.

2. You agree to post only information that adheres to all aspects of this document.

3. You are solely responsible for all content that you post on BREAKFALL.NET.  You agree that you have permission to post any content that you add to the BREAKFALL.NET website.

4. You agree that BREAKFALL.NET does not endorse or support any user opinions, and that the owners of all such opinions are the posters of such content.

Account Termination Policy

1. You agree that BREAKFALL.NET can remove your account for violation of any of these terms of use, or any actions that the staff of BREAKFALL.NET deem, in their sole discretion, to be contrary to community standards. 

2. BREAKFALL.NET retains the sole right to determine whether content or user actions are appropriate or whether they are in violation of any of these policies or contrary to community standards.

Warrenty Disclaimer

You agree that the use of this BREAKFALL.NET website is at your own risk and disclaim all warrenties, express or implied, in connection with the website and your use thereof.  BREAKFALL.NET assumes no liability for content posted on its website, or on any websites linked from it, including but not limited to content of advertisements.  Further, BREAKFALL.NET assumes no liability for (i) any errors, mistakes or ommissions in content, (ii) personal injury or property damage arising from your use or misuse of this website, (iii) any unauthorized access to our services or personally-identifying information, (iv) any interruption of service from our website, (v) any bugs, viruses, trojan horses or other software that may be transmitted through this website, or (vi) for loss or damage of any kind arising from the use of this website.

Limitation of Liability

In no event shall BREAKFALL.NET, its owners, operators, officers or staff be liable to you for any direct, indirect, incidental, special, punitive or consequential damages whatsoever resulting from (i) inaccuracies or ommission of BREAKFALL.NET content, regardless of the source, (ii) personal injury or property damage, of any nature, resulting from your access and use of our website and the information contained within, (iii) any unauthorized access to our servers or to any personally-identifiable information contained within, (iv) any interruption or cessation of services, (iv) any bugs, viruses, trojan horses or other malicious software transmitted through this website, its partners or any website linked herefrom, (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted or otherwise made available via the BREAKFALL.NET website, whether based on warranty, contract, tort, or any other legal theory, and whether or not BREAKFALL.NET is advised of the possibility of such damages.  The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

You specifically acknowledge that BREAKFALL.NET shall not be liable for user submissions or the defamatory, offensive, tortious or illegal conduct of any third party, and that the risk of harm or damage from the foregoing rests entirely with you. 

Jurisdiction

BREAKFALL.NET operates from within the United States of America.  It is not certified for use from any other location, and compliance with any local laws lies with the user.

Idemnity

You agree to idemnify and hold harmless BREAKFALL.NET, its owners, operators, officers and staff, from and against any and all claims, damages, obligations, losses, liabilities, costs or debts and expense, including but not limited to attorneys fees, arising from (i) your use of the Website or any content contained therein, (ii) your violation of any of these Terms of Service or community standards, (iii) your violation of any third party right, including but not limited to intellectual property or privacy rights, and (iv) any claim that a User Submission caused damage to a third party.
